Bestteegifts provides an internet-based platform that allows its users to design and sell their own T-shirts and other merchandise. We contractually prohibit our users from designing or selling merchandise that infringes the intellectual property rights of third parties, including copyright, trademark, and related rights. If you believe that a user of Bestteegifts has infringed your intellectual property rights, please follow the procedure outlined below to file a complaint.
A. Procedure for Reporting Intellectual Property Infringement
It is Bestteegifts policy to:
- Block access to or remove any content (including, without limitation, text, graphics, and photos) that we believe, in good faith, infringes the intellectual property rights of third parties upon receipt of a compliant notice.
- Remove and discontinue service to repeat infringers.
If you believe that content on the Bestteegifts platform constitutes copyright infringement, or that your intellectual property rights have been violated, please send a notice of infringement containing the following information to the Designated Agent listed below:
1. Identification of the Copyrighted Work or Other Intellectual Property:
Provide identification of the copyrighted work or intellectual property that you claim has been infringed, including any applicable registration numbers.
2. Identification of the Infringing Content:
Provide a description of the material you believe is infringing and how it uses your copyrighted work, including a description of where the infringing content is located on Bestteegifts platform.
3. Your Contact Information:
Provide your full name, mailing address, phone number, and email address.
4. Statement of Good Faith Belief:
Include a statement that you have a good faith belief that the disputed use of the intellectual property is not authorized by the copyright holder, its agents, or the law.
5. Statement Under Penalty of Perjury:
Include a statement made under penalty of perjury that the information provided in the notice is accurate and that you are the rights holder or are authorized to act on behalf of the rights holder.
6. Signature:
Provide an electronic or physical signature of the person authorized to act on behalf of the rights holder.
B. Once Proper Bona Fide Infringement Notification Is Received:
Bestteegifts policy is to:
- Remove or disable access to the allegedly infringing content.
- Notify the member whose content has been removed or disabled.
- Remove the content of repeat offenders and terminate their access to the platform.
C. Procedure to Supply a Counter-Notice:
If the notified member believes that the content removed or blocked is not infringing or that they have the right to use such content, they may submit a counter-notice with the following information:
1. Identification of the Content:
Provide a description of the content that was removed or disabled, including where it appeared on Bestteegifts before being removed.
2. Statement Under Penalty of Perjury:
Include a statement under penalty of perjury that you have a good faith belief that the content was removed due to a mistake or misidentification.
3. Your Contact Information:
Provide your full name, mailing address, phone number, and email address.
4. Statement of Jurisdiction:
Include a statement that you consent to the jurisdiction of the Federal Court for the judicial district in which your address is located, or if outside the USA, for the judicial district where Bestteegifts is located.
5. Signature:
Include your electronic or physical signature.
If a counter-notice is received, Bestteegifts may restore the removed content in 10-14 business days, unless the rights owner files an action seeking a court order.
Note: Under Section 512(f) of the DMCA, any person who knowingly misrepresents that content is infringing may be liable for damages, including attorney’s fees.
